SUNFLOWER AVENUE PTY LTD - TERMS & CONDITIONS

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of the Sunflower Avenue Pty Ltd website (“Store”) and the purchase of any products from us.

By accessing the Store, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms.

  • You, your, customer refers to any individual or entity accessing the Store or purchasing from us
  • Products refers to all goods available for purchase via the Store


3. Pricing

All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated.

We reserve the right to change prices at any time without prior notice.


4. Payment

We accept payments via eftpos, Visa, Mastercard, and PayPal.

By placing an order, you agree to pay all applicable charges, including any transaction or processing fees imposed by your payment provider.

We reserve the right to cancel or refuse any order if payment is not successfully processed.


5. Product Descriptions & Availability

We strive to ensure all product descriptions, images, and details are accurate. However, we do not warrant that product information is error-free, complete, or current.

Colours may vary slightly due to screen settings and lighting.

All products are subject to availability. We reserve the right to limit quantities, refuse orders, or discontinue products at any time.


6. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL).

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.


7. Returns & Refunds

We accept returns within 30 days of purchase provided that:

  • The item is unused, unworn, unwashed
  • All original packaging and tags are intact
  • Proof of purchase is provided

We do not offer refunds for change of mind unless required under Australian Consumer Law.

Items deemed faulty will be assessed and, where applicable, repaired, replaced, or refunded in accordance with ACL.


8. Security

We take reasonable steps to ensure the Store is secure. However, you are responsible for maintaining the confidentiality of your personal information and any account details.

We are not liable for any unauthorised access resulting from your failure to safeguard your information.


9. Limitation of Liability

To the maximum extent permitted by law, Sunflower Avenue Pty Ltd will not be liable for any indirect, incidental, special, or consequential loss, including loss of profit, revenue, or data arising from:

  • Use of the Store
  • Purchase or use of Products
  • Delays, interruptions, or errors in the Store


10. Warranties

Any warranties provided with Products are in addition to your rights under Australian Consumer Law and do not replace or limit those rights.


11. Intellectual Property

All content on the Store, including but not limited to logos, designs, graphics, images, and text, is the property of Sunflower Avenue Pty Ltd or licensed to us.

You may not reproduce, distribute, or use any content without prior written consent.

We will aim to resolve all issues promptly and fairly. Where a resolution cannot be reached, we may agree to participate in an appropriate dispute resolution process.

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.


15. Changes to Terms

We reserve the right to update or modify these Terms at any time. Updated Terms will be published on the Store and take effect immediately upon posting.
